"Anti-selfie" bill in Congress

MANILA Philippines - If you're the type of person who enjoys taking random snapshots of
people, places, things and even the ubiquitous selfies and groupies and then posting them on social media, better be careful.
According to Bayan Muna Rep. Carlos Zarate, there's a bill in Congress that seeks to bar taking photos of people without their permission.
House Bill 4807 or the Protection against Personal Intrusion Act is now up for 3rd reading in plenary.
It defines "intrusion of personal privacy" as "any person who willfully intrudes into the personal privacy of another, without the consent of that person and with the intent to gain or profit therefrom, shall be civilly liable to the offended party."
"HB 4807 will create a chilling effect on media and would especially affect citizen journalism. It would punish with civil suit taking photos, video or even audio recording anything claimed as a personal/ family matter even of public officials and personalities," Zarate said.
"Even an innocuous selfie with public figures at the background would be liable for 'intrusion of privacy'. This is absurd and we urge our colleagues to reconsider," he added.
According to HB 4807, the following acts are considered an intrusion into the personal privacy of another and shall be presumed to have been committed with the intent to gain or profit.
-capturing by a camera or sound recording instrument of any type of visual image, sound recording or other physical impression of the person
-trespassing on private property in order to capture any type of visual image, sound recording or other physical impression of any person
-capturing any type of visual image, sound recording or other physical impression of a person or family activity through the use of a visual or auditory enhancement device even when no physical trespass has occurred, when the visual image, sound recording or other physical impression could not have been captured without a trespass if no enhancement device was used.
Section 4 of the bill says any person whose personal privacy was intruded as defined may in a civil action against the person who committed the intrusion, obtain any appropriate relief, including compensatory damages, punitive damages, and injunctive and declaratory relief.
Any person obtaining relief may be either the person whose visual or auditory impression has been captured or the owner of the private property trespassed to capture the visual image, sound recording or other physical impression of another.
"The fact that no visual image , sound recording or other physical impression of a person was actually sold for gain or profit shall not be available as a defense in any civil action or proceeding for the enforcement of the provisions of this act," the bill explained.
The only exemption from this act are legitimate law enforcement activities.
The bill is authored by Congressmen Rufus Rodriguez, Maximo Rodriguez, Jorge Almonte, Gwendolyn Garcia, Linabelle Ruth Villarica, Lito Atienza and Leopoldo Bataoil.
NO MORE SELFIES, PAPARAZZI?
Critics said the bill has wide ranging implications on press freedom and even social media.
Jose Torres Jr., board member of the Photojournalists’ Center of the Philippines (PCP), Inc., said the bill needs to define what "intent to gain or profit therefrom" means.
"It would seem that people from the media and journalists can be targets of the proposed measure. Worthy of being emphasized is the phrase 'with intent to gain or profit therefrom.' In case a complaint is filed in court against a photojournalist, can lack of intent to gain be used as defense?
"It must be clearly defined what can be classified for 'gain' or 'profit.' News outfits - newspapers, magazines, television, online publications, radio, and news wire agencies - are basically for profit organizations. There must be clear provisions that specify that news gathering must be exempted from this section," he added.
The group said it wants media to be exempted from the coverage of the proposed law.
"We suggest to add the qualification 'unless this is done in the practice of a media professional in the interest of public interest.' If we limit Sec 3 a, Sec 3 c will then apply only to the protection of privacy clause."
The group is also pushing for a definition of "private property."
"Private property must be spelled out and defined. Public places, cars, public transport, public buildings, among others, and individuals, who by nature of their position or profession are classified as public figures, cannot claim violation of privacy. Does 'personal privacy' extend to public domain or public places in private spaces, for instance malls, shopping centers, events venues, a luxurious resort, among others?"
On the matter of capturing any type of visual image, the group said this provision can affect journalists who use modern legitimate tools of news gathering like drones with cameras or telephoto lenses.
The group proposed that news and visual storytelling that fall into educating, warning, exposing incidents and events that will benefit the majority of society must be exempted because interest groups can use provisions of the law to put enterprising journalists in tough situations.
The group also wants a corresponding provision of penalty for grave use of authority and clear use of provisions of the law for harassment of journalists.
"Our apprehension is based on the premise that the act being made punishable by this proposed measure is not clearly defined to the point that many acts can be considered 'malum prohibitum' or conducts that constitute an unlawful act only by virtue of statute as opposed to conduct evil in and of itself."
"We worry that this proposed measure can become a tool that 'unwilling public figures' will use to suppress press freedom."

Businessman, cop arrested over racing champ Enzo Pastor slay–police

MANILA, Philippines — The mastermind and his hired gunman, allegedly a Pasay City
policeman, behind the killing of racing champion Ferdinand “Enzo” Pastor have been arrested, police said.
Senior Inspector Maricar Taqueban, public information chief of the Quezon City Police District, confirmed the arrest of the suspects and said they would be presented to the media this Wednesday.

In a radio report, Police Officer 2 Edgar Angel admitted to the authorities that he was paid P100,000 to ambush Pastor.
The report, however, did not identify the arrested businessman who gave orders to Angel.
Radio reports also said the victim’s father Tom Pastor went to the Quezon City Police District (QCPD) to file cases against the businessman and the police.

In July, Davao City Mayor Rodrigo Duterte offered a P1-million bounty for the capture of the assailants.

Duterte claimed he was a friend of the slain racer’s father.

‎Pastor, who had just won a racing competition in Batangas, was shot “11 times” by a masked gunman on a motorcycle at a Quezon City intersection last June 12.
Days after his killing, the QCPD formed a seven-man investigating team to focus on the murder of Pastor.

The case prompted Interior Secretary Manuel “Mar” Roxas to order the Philippine National Police to form special investigation teams to look into such high-profile cases, including the murder of hotel chain owner Richard King in Davao City.

Justice Secretary Leila de Lima and BIR Commissioner Kim Henares took the trending ALS Ice Bucket Challenge.

Perceived to be two of the toughest women in President Aquino's Cabinet, Justice Secretary Leila de Lima and BIR Commissioner Kim Henares took the trending ALS Ice Bucket Challenge.

BIR Commissioner Kim Henares

MANILA, Philippines—Internal Revenue Commissioner Kim Henares had shown in the past that ice runs through her veins when running after tax evaders, but on Tuesday, she had a bucket of ice and ice-cold water poured onto her in an effort to raise awareness on a disease that affects the nervous system.
Hernares accepted the ALS Ice Bucket Challenge posed to her by news anchor Anthony Taberna. The dare is for a fundraising effort to raise awareness on amyotrophic lateral sclerosis (ALS) or Lou Gehrig’s disease.

Justice Secretary Leila De Lima
MANILA, Philippines – Justice Secretary Leila De Lima dared former Senator Panfilo Lacson, Iloilo Representative Niel Tupas and Davao City Mayor Rodrigo Duterte to take the ice bucket challenge.
De Lima issued the challenge after being drenched with water and ice at the Department of Justice Tuesday.
She was earlier dared by a television news anchor to take the ice bucket challenge.
De Lima said she loves challenges, especially for a worthy cause.

European willing to buy old cellphones for $59 each

Do you still own some old cellphones with brands like Nokia, Motorola, and Sony Ericsson?
Europeans are willing to buy our old cellphones for the price of $59. They prefer old cellphones we thought were meant to be thrown to trash or kept on the drawer because they’re just good enough for texting and calling.

Old cellphones we first known were obviously durable and can last for almost 10 years if we take care of them properly. I just thrown 2 old phones last week because I though they don’t have any value at all. They’re still functioning but for sure no one on my relatives or friends would like to adopt them. One of the cellphones was an old Motorola with flip cover and the other one was an iPhone 3gs replica.

I still have functioning and very old model of Sony Ericsson with camera and video call on my drawer. I also have another Sony Ericsson with flip cover that can access the internet via GPRS (For emergency uses). I just hope I live somewhere in Europe so I can take advantage of selling it even for a value lower than $59

London - Lamborghini Aventador Crash

An earlier video shows the moment of impact as it happens.
Just yesterday, we told you about a Lamborghini Aventador crash that happened last weekend in London. At first, we only had videos of the impact’s aftermath, the Lamborghini seen with damage to both sides of its front end. Now, thanks to our friend Shmee, we have the actual crash caught on video, and so the debate can begin: was the Aventador driver going too fast for the city streets, or was it the Mazda’s fault for not giving him the right of way?
At least the driver did not take off right away as we had previously believed. See it happen at the ‘Moment of Impact’:

First helium balloon in Philippines flies in Lapu-Lapu city Cebu

Considered as the first of its kind not only in Cebu but also in the entire Philippines, the “Helium Balloon Ride“, which is found in Hadsan Resort in Barangay Agus, Lapu-Lapu City, is the newest attraction in the island. Aside from the classic Balloons in Lapu-Lapu City, this Helium Balloon Ride is the perfect family getaway adventure during the weekend.

Disclaimer: I do not own the video.
Source: Youtube-Netizen News

Formally launched on August 15, 2014, with the attendance of Mayor Paz Radaza and Korean owner Jack Song, this helium balloon is safe because it passed international safety standards. The facility personnel coordinates with the CAAP (Civil Aviation Authority of the Philippines) and PAGASA Weather Bureau to avoid any untoward incidents.

Hydrogen and Helium, which are gases used in inflating ordinary balloons for birthdays can make this Balloon Ride fly up in the air. Unlike Helium, Hydrogen is an explosive gas making it impossible to use in this huge balloon, which can carry up to 30 persons at one time. Helium is the only gas safe for this balloon, which is obviously why they named it as such.
The Helium Balloon Ride can fly to as high as 150 meters, which is enough to give you a panoramic view of the whole island, including parts of mainland Cebu. It has a diameter of about 23 meters and a total height of 34 meters, from base to the topmost part of the balloon. The design of the Helium Balloon Ride is almost similar to the Hot-Air Balloon but the huge difference between the two is that most of the Hot-Air Balloon Ride can fly freely, unlike the Helium Balloon, which has a control cable that can handle up to 45 tons and it is analogous to a kite or a parasail because of the string used to make it go further up or go down.

Open from 9:00am to 9:00pm daily, the Helium Balloon ensure harmless flights. For more than 15 years in operation in 20 different countries, the Helium Ride has been operating without accident. The Helium Balloon, also known as the AERO30NG is made by France Aerophile, which has an almost 20 years of experience in making high-quality commercial balloons.
Locals and foreigners pay a different rate. Filipino adults pay P1,000/each while children 2 to 12 years old is at P700/each. Foreigners are charged $50 for adults and $30 for children.

Several well-trained pilots who operate the balloon ride and determine if the wind or weather condition is too much to handle or it is in “flying condition”, makes sure all the guest enjoy their ride and not panic. Perimeter lights and CCTVs will soon be available in the venue. There will also be a tourist police to secure the area.
For bookings and reservations of the helium balloon tour, the operator can be reached at 0916-281-1234 and 0921-994-1234.
P.S. We really love heights and the adrenaline rush it gives us. We hope we can ride this Helium Balloon very soon but because of the price, it will probably take us a few weeks or months to save money for it.

Bettina Carlos denies dating Raymart Santiago

Manila Philippines - Actress Bettina Carlos would rather distance herself from controversy
magnet Raymart Santiago, the man she’s being linked to recently.

The 26-year-old Kapuso actress finds it funny that people instantly equate their onscreen closeness with reality.

"Natatawa nga kami doon. It looked like it was parang really linking us but in reality it’s just out of the show. It was during the time when our characters are becoming lovers,” she told showbiz reporters, referring to their roles in the recently-concluded afternoon drama “Villa Quintana.”

Bettina further said only two things bind her and Raymart together: Instagram and “unyon," their newfound showbiz group composed of some “Villa” cast members, including Bettina, Raymart and Sunshine Dizon.

"Instagram lang (ang connection namin). We follow each other. We have a lot of interests in common… (at least kami) sa group ha, like Ate Shine cooks a lot, tapos ako I bake tapos si Raymart pala cooks also.”

She added, "The only time nakakasama namin siya sa labas is kapag lumalabas ang ''unyon.'"

No to controversy

Did Raymart show interest in her?

"Hindi pwede! Ang tahimik-tahimik ng buhay ko ayoko nang gumulo. Wala, wala. He has a lot of issues to deal with in his personal life."

Bettina must be referring to the 41-year-old actor’s never-ending saga with his estranged wife, Claudine Barretto.

For now, the single mom is focused on her career, her pastry business, and of course her daughter.

"Hindi ko pa nararamdaman 'yung need for that (relationship) at this point. So dahil wala pang need, hindi. ko pa namimiss 'yung feeling. Siguro when the time God wants me to be with someone, darating din ‘yan."

The actress-entrepreneur also pointed out that she’s more selective of her future relationship, especially since she has a daughter to consider.

"I’m hoping that my next relationship will be with someone na magiging tatay ng anak ko and tatanggapin niya ko. So hindi rin ganun kadali for me to find someone at this point.”

‘Internet entrepreneur’

Aside from showbiz, Bettina makes herself  busy with her pastry business.

The “Internet entrepreneur” has social media to thank for in helping her run a business she put up from her home over three years ago.

"We’re blessed to be part of the free marketing age. We have with us Facebook, Twitter and Instagram. And of course, free photo editing apps that really help you enhance photos and make them look like they're professionally taken. Malaking bagay.”

Bettina is fortunate she can combine showbiz and her small-scale business.

"Mabait talaga ang Diyos. Kapag binubuhusan Niya ko ng orders, ibig sabihin wala ako masyadong taping. Kapag may taping ako, manageable lang ang baking load ko.”

She personally takes note of orders and bakes at the same time. Her first and only hire, a rider, delivers the goods within Metro Manila.

"I’m very lucky that my customers understand that there’s no definite time of delivery—within the day lang talaga,” she said, sharing that her rider services 20 locations on an average day.

Baking is something she and her 3-year-old daughter enjoy doing, too.

“Every time I go to my kitchen, she’s with me. Nasa tiyan ko pa lang siya nagbe-bake na ko. She’s there pretending she has her own baking show."

[SHOWBIZ]: Dingdong Dantes, Marian Rivera considering a prenup agreement

Dingdong Dantes and Marian Rivera have yet to discuss their prenuptial agreement, but the engaged couple maintained it’s something they should consider before settling down on December 30.
“Pag-uusapan pa lang namin ‘yan. Isa ‘yan sa mga bagay na hindi mo talaga pwedeng hindi pansinin,” Dingdong told the media on Friday (August 15) at the GMA Network Center. "So yes, definitely it’s part of our agenda that we have to finalize.”
High-profile couples, especially celebrities, normally enter into premarital contracts, which include division of property or spousal support should the couple get separated.
Kris Aquino and former husband James Yap entered into this kind of agreement.
Learning from others
The GMA royal couple is also learning from marriages which failed due to mishandled finances.
"Naiintindihan ko... ‘yan din ang nagiging ugat ng maraming problema ng mag-asawa. Ayaw namin mangyari ‘yun base na rin sa nakita naming experience in the past, that’s why it’s something we have to settle,” the 34-year old actor said.
Understandably though, the couple is still on cloud nine and separation is not in their vocabulary.
"Ganun kahalaga ‘yung sacrament ng matrimony sa’min. Once na nandun na ‘yan, siguradong sigurado ka na dapat. ‘Yung pagtatapos niyan should not be an option,” Dingdong said.

Groom foots the bill
Dingdong divulged that he is paying for all the wedding expenses, except for Marian’s bridal shoes, which she has already purchased.
Meanwhile Dingdong neither confirmed nor denied that the Classic Winston, 2.13 carats Emerald-Cut diamond engagement ring cost him P4 million.
“Ang tingin ko ang pinakamahalaga talaga e ‘yung intention kung bakit ko binigay. Hindi ko masasagot ‘yun (real cost).”
The Kapuso Primetime King added that he’s lucky because money has never been an issue during his five-year relationship with Marian.
"Never namin naging problema (ang pera). Si Marian is very generous pagdating sa ibang bagay. Makikita mo rin naman even how she deals with other people.”
Knowing they’re each other’s 'the one'
Dingdong said that while age is a factor, knowing that Marian is ready to sacrifice for him made him realize that he has found Miss Right.
"I think ‘yung spiritual preparedness e, 'yung level of maturity. Malaking factor na rin 'yung edad, pero ang pinakamahalaga sa lahat e ‘yung willingness to start a family. Malaking bagay sa’kin 'yung willing mag-sakripisyo at gawing priority ang pagbuo ng pamilya. Hindi naman lahat ganun ang thinking. Mapalad talaga ko na ganun 'yung sa kanya.”
Marian, for her part, said Dingdong exerts a good influence on her.
"Siya 'yung tipong partner na dadalhin ka niya sa mas magandang pananaw, mas mabuting pag-uugali. Siya 'yung isa sa mga dahilan ko para maging mabuting tao."

Serena Dalrymple grows-up!

Serena Dalrymple, 23 is now a student in London where she is taking up postgraduate studies.  The former child wonder, who rose to fame in 1997 for her “Isa pang Chickenjoy” TV ad, she considers her “most memorable” role, Dalrymple acted alongside film veteran Vilma Santos in Chito Roño’s “Bata, Bata… Pa’no Ka Ginawa?” in 1998 when she was only 7.
In 2003, she debuted as a teen star via the first “Ang Tanging Ina” movie. Dalrymple, who played comedienne  Ai Ai delas Alas’ daughter in the blockbuster, was evidently no longer the child star with the signature boyish haircut.
BEFORE:

Her last professional engagement as an actress was the same character in 2010, when the third entry in the comedy film series was released.
NOW...
Dalrymple graduated from De La Salle-College of St. Benilde in Manila with a Business Administration Degree. She then left for Los Angeles to work there for a year, “but I realized that I still don’t know what I want to do.”
“So I decided to take up masters hoping it’ll help me figure things out,”
She only recently started her studies in Master of International Business at the Hult Internationa Business School London, having transferred to the United Kingdom in August this year.

Facebook owner - Mark Zuckerberg Dumps Ice On Himself For ALS Awareness, Passes The Challenge Onto Bill Gates

Snark all you want about this wonderfully goofy trend of dumping ice water on your head to raise
ALS awareness, but here’s the deal: it’s working. Donations to the ALS Association are up by 1000%. Plus we get to see people like Zuck dump friggin’ ice on their heads.
ALS, or Amyotrophic lateral sclerosis, is a fatal neurodegenerative disease that attacks the brain and spinal cord. You can find more information here, and donate to the ALS Association here.
Following up on a challenge from New Jersey Gov. Chris Christie, Zuck dumped the bucket on himself in what seems to be his backyard. And since it’s tradition to pass the icey-torch onto at least three people, he called out Bill Gates, Sheryl Sandberg, and Reed Hastings to do it next.
Seriously though: if Bill Gates does it, I think we’ve reached max absurdity. Game over, achievement unlocked.

“Yung buntis issue since 18 years old ako, kapag lumalabas ako ng bansa ay buntis ako at kapag payat akong bumabalik ay nagpa-abort.

Jobelle Bascug Is The Beautiful Sexy Shoplifter In Cebu - Video

19-year-old Jobelle Bascug entered a boutique in Mandaue City in Cebu, Philippines
on Tuesday and went out of the shop wearing the establishment’s dress, high-heeled shoes, jewelry and shoulder bag without paying. GMA Cebu’s Lou-Anne Mae Rondina reported Wednesday that sales personnel were surprised over the theft as they observed the woman staying inside the shop for two hours and trying out the items there.
A sales attendant described Bascug as physically attractive.
Authorities identified Bascug because she left behind the clothes she wore before entering the shop along with a boat ticket with her full name printed on it. Her identity was confirmed when they searched and found her account on Facebook.
The owner of the boutique, Jessa Romagos, contacted Bascug, who promised to pay for the items. But Romagos said she is still pursuing charges against Bascug.

Unbelievable! Praying mantis prey on mice...

Viewers discretion is advised.

Mantis' eat other arthropods from bees to moths and from beetles to spider. They are capable of eating small reptiles like snakes to lizards, and also small rodents to even small birds. Because mantis' do not have venom or constriction, the use their powerful front legs as a scythe to devour prey alive. The begin with the prey's neck and head to paralyze and hopefully kill the prey to minimize scrambling and acts of further defense. IDENTIFYING PYRAMIDING SCAMS by Josiah Go

Among the multilevel marketing (MLM) or network marketing compensation plans being used (and abused) nowadays is the binary plan. This kind of plan allows distributors to have only two direct or first-level distributors.
Any additional distributors sponsored have a “spillover” effect, meaning, they are placed at levels below the sponsoring distributors’ first-level. Compensation is paid based on balancing volume on the right and left leg.
There is no law that states that a binary compensation plan is illegal or is a pyramiding scheme, however, binary plans, being one of the five more popular types of network or multilevel marketing compensation plans, operate under the same laws that govern other multilevel marketing schemes, specifically the provision that disallow the practice of pyramiding schemes.
Article 53 of R.A. 7394 of the Consumer Code of the Philippines states “Chain distribution plans or pyramid sales schemes shall not be employed in the sale of consumer products.” Network / multilevel marketing companies, including those using binary plans, must therefore clearly distinguish themselves from those operating pyramiding schemes.

The Direct Selling Association of the Philippines (DSAP) has its 8-point test for pyramiding:
Is there a product?
Are commissions paid on sale of products and not on registration/entry fees?
Is the intent to sell a product not a position?
Is there a reasonable product return policy?
Is there no direct correlation between the number of recruits and compensation?
If recruitment were to be stopped today, will the participants still make money?
Do products have fair market value?
Is there a compelling reason to buy?
The DSAP recommends that if the answer to all the questions is YES, then the company being evaluated is a legitimate company. But if the answer is NO to some, then there is a high probability that it is a pyramid scam.
Here are two cases:
Company A pays commission to their network members based on balancing the number of people on the right leg and left leg. Is this pyramiding?
Company B encourages a new distributor to sign up as many as seven different “business centers” (known as 7-headers in the industry). Is this pyramiding?
The answer to both questions above is yes, they are both pyramiding. The first violates number 5 and 6 above while the second case violates 3, 5 and 6. In fact, the relative big amount of investment required for buying multiple business centers such as 7-Headers may constitute selling an unregistered investment contract. Furthermore, since binary plans are known for their “spillover” effect, the distributor-investor is led to anticipate profits primarily from the efforts of the others, constituting a passive investment (paging the Securities and Exchange Commission).
But why is the binary plan attractive?
Firstly, the “spillover” concept attracts new distributors because technically, they can receive commissions by sponsoring only two distributors and let uplines (those who signed up earlier) do the “spillover” for them. Then, binary plans are quite simple to understand, which allows distributors to duplicate their effort easier, a necessary tool to succeed in network/multilevel marketing. Finally, binary plan offers fast-paced growth opportunities, which attract the “greed” segment of our population who wish to “get-rich-quick”.
Unfortunately, legitimate network/multilevel marketing companies have been grouped together with the bad eggs of the industry. In fact, the worst scenario is in the late 1990s when China banned all direct selling and network marketing operations because of the presence of many unscrupulous individuals and companies that gypped consumers of their money into investing in pyramiding operations.
Binary plans are not illegal per se. It becomes illegal if the design is abused to create wealth from recruiting. To existing binary companies violating certain practices, there is still time to correct these deficiencies before government regulators catch up and force these changes through regulatory actions, but when pride and emotions get in the way, logic is seldom followed and the companies, as well as the plan originator, defend their defective binary plans instead of listening to potential remedies.
